Terms of Use
Terms covering the use of delyavia.com, set out in short clauses. The section worth slowing down for is the second one, because readers routinely assume the opposite of every line in it.

1. Who is behind this and what agreeing means
1.1 Delyavia.com is operated by Delyavia Imprint LLC, a New York limited liability company at 500 Seneca Street, Buffalo, NY 14204, United States. Below, that company is called the publisher.
1.2 Opening any page of this domain brings these terms into effect between the publisher and the reader.
1.3 Anyone unwilling to accept them should close the site. Doing so forfeits nothing, since there is no account here, no subscription and no purchase.
1.4 Every page falls inside these terms. Reports, section indexes, plates, the two forms, all of it.
2. What the publisher never does
2.1 Nothing on this domain is for sale. There is no shop, no basket, no checkout stage, no figure with a currency symbol beside it, and no channel through which a reader could pay the publisher.
2.2 No travel is booked, held, reserved or assembled. The publisher does not operate as an agency, an operator, a reservation platform, a comparison service, or anybody's representative.
2.3 No payment is ever taken. Consequently no payment instrument is accepted, no card data is collected, and no billing arrangement exists. A refund is impossible because a charge is impossible. Any page elsewhere collecting money in the name of this journal has no connection to it.
2.4 Nothing is dispatched. No physical article exists here, so questions of carriage, destination, timing and cost do not arise, and no returns procedure exists because an item that cannot be bought cannot be sent back. Were a later version of this site ever to list something for sale, the full commercial terms would be published in advance of the first listing.
2.5 No relationship of any kind connects the publisher to an airline, a hotel chain, a resort, a vehicle hire business, a tour company or a booking service, and no sentence here is written on behalf of one.
3. Editorial material and its limits
3.1 A report is one writer's account of a small number of days in one place, assembled in good faith with reasonable care.
3.2 It is not a professional engagement, an inspection, an accreditation or a warranty of any kind.
3.3 Cold season conditions move quickly. Gates get padlocked between seasons, maintenance stops on a road, a stairway closes and stays closed, a permit rule appears. Material true at publication may be false when read, which is why each report carries its date.
3.4 Corrections are printed above the affected report with the date attached.
3.5 The working notes describe habits belonging to one person with a tripod. They stand in for nothing: not a posted warning, not a closure, not highway advice, not a ranger, not a lifeguard, not a forecast issued this morning. Where any of those conflicts with this journal, the official source governs.
3.6 Where somebody chooses to stand, and what they choose to walk onto, is their own decision and their own responsibility.
4. Copyright and quoting
4.1 Text, photographs, layout, design and code here belong to Delyavia Imprint LLC and carry copyright protection. None of it sits in the public domain and none of it is offered under an open licence.
4.2 Permitted without asking: reading, printing a page for private use, and lifting a sentence or two for comment or reference where a visible credit and a link back are supplied.
4.3 Not permitted: reproducing a report in whole or in substantial part; placing a photograph on another site, service or account, credit line or no credit line; feeding material from here into the training of a model or into a dataset; licensing or selling any of it; presenting it as somebody else's work; systematic scraping.
4.4 Requests to use a photograph are considered individually. Write to [[email protected]](mailto:[email protected]) stating the placement, the context and the duration.
5. Copyright complaints
5.1 A rights holder or their representative who believes something here infringes should write to Delyavia Imprint LLC, 500 Seneca Street, Buffalo, NY 14204, United States, or to [[email protected]](mailto:[email protected]), addressed to the copyright agent.
5.2 A useful complaint names the protected work, names the page here carrying the disputed material, supplies contact details, asserts a good faith belief that the use was unauthorised, and confirms the accuracy of what has been stated.
5.3 Complaints meeting 5.2 are acted on without delay.
6. Acceptable use
6.1 The site exists to be read.
6.2 Do not attempt entry to any part of it, or to the machinery behind it, that was not offered.
6.3 Do not probe or test its security, and do not introduce anything hostile.
6.4 Do not harvest the contents by automated means or place unreasonable demand on the host.
6.5 Neither form is a route for unsolicited sales approaches, reciprocal link proposals, article pitches or abuse, and neither is a place to use somebody else's name.
6.6 Access may be withdrawn where any of clauses 6.2 to 6.5 is breached, and no warning is owed.
7. Links
7.1 No page here links outward to another website.
7.2 The single external request this site makes is the one carrying a form somebody chose to send.
7.3 Were an outward link ever added, it would carry no endorsement of the destination, and the publisher would exercise no control over its content, its handling of data, or its continued existence.
8. Warranties
8.1 The site and everything on it is supplied in the state it happens to be in, and as it happens to be available.
8.2 No warranty is given, in words or by implication, and specifically none regarding satisfactory quality, suitability for a particular purpose, factual accuracy, or freedom from infringement.
8.3 No undertaking is given that the site will run without interruption, without fault, or securely, that its contents are complete or current, or that a defect will be repaired.
8.4 Where local law declines to permit an exclusion in this clause, that exclusion operates only to the extent the law allows.
9. Liability
9.1 To the fullest extent the law permits, neither the publisher nor anybody associated with it bears liability for indirect, incidental, special, consequential or punitive loss, nor for loss of profit, revenue, data or goodwill, however it arises from the use of this site or from reliance on its contents.
9.2 Where liability cannot lawfully be set aside, the aggregate recoverable in connection with this site stands at one hundred United States dollars. Nothing here has ever been purchased, so that figure caps exposure rather than returning money.
9.3 Clauses 9.1 and 9.2 do not touch liability for fraud or fraudulent misrepresentation, nor anything else the law forbids limiting.
10. Indemnity
10.1 A reader who breaches these terms, or who misuses material taken from this site, and who thereby exposes the publisher to a claim, a loss or reasonably incurred legal costs, agrees to make the publisher whole.
10.2 Reproducing reports or photographs without permission is the plain example of clause 10.1.
11. Governing law and forum
11.1 These terms, and any dispute connected with them or with this site, fall under the laws of the State of New York, conflict of law rules disregarded.
11.2 Proceedings belong exclusively before the state or federal courts sitting in Erie County, New York, and both sides submit to that jurisdiction.
11.3 A consumer resident elsewhere retains the benefit of any mandatory protection given by the law of their own home.
12. Changes, severability and scope
12.1 These terms may be revised. A revision moves the date printed at the head of this page, and reading the site afterwards means the revised version applies.
12.2 A material revision stays flagged on this page for ninety days at minimum.
12.3 An unenforceable provision is trimmed or set aside only so far as necessary; the rest continues in force.
12.4 This page, together with the Privacy Policy, the Cookie Policy and the Disclaimer, constitutes the whole arrangement between a reader and Delyavia Imprint LLC concerning delyavia.com.
